Querencia Los Cabos Case Glossary: Pretrial Judge, Prosecutors, Investigation File and More

This Querencia Los Cabos case glossary explains, in plain English, the legal terms in the criminal case over a March 25, 2025 accident in San José del Cabo, Mexico. It covers what a pretrial judge (Juez de Control) is, what the Public Prosecutor's Office does, what an investigation file is and what a charging hearing means. The definitions are general. When a term appears in the case, the page says what is on record, with its date.

Who is involved

Pretrial judge (Juez de Control). A judge who oversees the investigation stage of a criminal case. In this case, on July 16, 2026, the judge set a hearing for August 26, 2026. More is in what happened before the pretrial judge.

Public Prosecutor's Office (Ministerio Público). The state office that investigates crimes and brings charges before a judge. In this case, on July 15, 2026, it asked the judge to hold a hearing to formally charge the driver and the club's doctor, both under investigation. The request also names a company, Querencia Construcciones, S. de R.L. de C.V. (a Mexican limited-liability company form, roughly comparable to a U.S. LLC). Details are in the request for a charging hearing.

Under investigation. A person being investigated for a possible crime. It does not mean the person committed it. In this case, the driver and the club's doctor are both under investigation.

Company (persona moral). A business or other legal entity, as distinct from a person. In this case, the July 15, 2026 request names one company, as noted above.

What is investigated

Investigation file (carpeta de investigación). The written record of an inquiry into possible crimes. In this case, the Baja California Sur state attorney general's office (Procuraduría General de Justicia del Estado de Baja California Sur) opened one. The reasons are in why an investigation was opened.

The file was opened for four offenses. In plain English:

  • Unintentional bodily injury: injuries caused without intent.
  • Property damage: damage to property.
  • Failure to render aid (omisión de auxilio): not helping an injured person or someone in danger.
  • Failure to file a medical report (omisión de informe médico): not giving the authorities the medical notice of someone's injuries.

Opening a file for these offenses does not mean anyone committed them.

The hearings

Charging hearing (audiencia de imputación; initial hearing). A hearing where prosecutors may formally bring charges. It is not a trial. In this case, the hearing was requested and set, as described above.

Postponed. A hearing moved to a later date. On August 26, 2026, the hearing was postponed to September 30, 2026, after the judge asked prosecutors for the name of the legal representative of the company under investigation.

How the authorities found out

C2. A command and monitoring center. In this case, municipal police handled a report from Hospital H+ Los Cabos through C2 at 12:54 p.m. on March 25, 2025, according to the police reports of March 25 and March 27, 2025. The authorities learned of the crash through the hospital, not through Querencia Los Cabos staff. The sequence is in how the authorities found out.

Early-attention unit (Unidad de Atención Temprana). A unit of the Public Prosecutor's Office. In this case, according to those reports, municipal police alerted it at 2:31 p.m. that day. At 2:59 p.m., it alerted the investigative police (Policía de Investigación).
