Querencia Los Cabos Accident: A Truck Rear-Ended a Golf Cart and a 5-Year-Old Girl Was Thrown From It
The Querencia Los Cabos accident happened around 10:15 a.m. on March 25, 2025, on Boulevard Querencia, a road inside the development in San José del Cabo, Baja California Sur, Mexico. Records show that a RAM 700 truck bearing Querencia markings struck a golf cart with one adult and three minors aboard from behind, and a 5-year-old girl was thrown out. Her discharge order records a Glasgow Coma Scale score of 9 on arrival at Hospital H+ Los Cabos; a CT scan ruled out brain or spinal injury. Police received no report from the scene, and the authorities learned of the crash from the hospital. On July 15, 2026, in a criminal case in Los Cabos, state prosecutors asked a pretrial judge (Juez de Control), who oversees the investigation stage, to hold a hearing to formally charge the driver and the club's doctor, both under investigation, and Querencia Construcciones, S. de R.L. de C.V. (a Mexican limited-liability company form, roughly comparable to a U.S. LLC).

What happened that morning, March 25, 2025
Boulevard Querencia is a road inside Querencia, the development in San José del Cabo known as Querencia Los Cabos. At around 10:15 a.m. on March 25, 2025, a RAM 700 truck bearing Querencia markings struck a golf cart there from behind.
The driver's interview and the inspection records describe it that way.
Questioned by a state investigator on March 26, 2025, the truck's driver, who is under investigation, said: "I got distracted for a few seconds looking down and could no longer avoid it" (translated from Spanish).
The collision threw the girl out of the cart. The hospital's notice to prosecutors records it.
Inspection records place the damage at the rear of the golf cart and at the front of the truck, where the grille, bumper, hood and front frame were damaged.
From the crash site to the hospital
She arrived at Hospital H+ Los Cabos at about 10:40 a.m., with her father and the club's doctor (under investigation) accompanying her. That arrival time comes from a report of the prosecutors' traffic-offenses unit dated March 27, 2025, and from a notice issued by the prosecutors' early-attention unit (Unidad de Atención Temprana).
Her discharge order records a Glasgow Coma Scale score of 9 on arrival in the trauma room, which improved to 14 after initial treatment. The hospital's notice to prosecutors records significant respiratory distress, crackles in both lungs and reduced oxygen levels. The Glasgow Coma Scale is a standard emergency-room measure of a patient's level of consciousness.
The diagnosis in her hospital records reads: pediatric polytrauma, head trauma, blunt chest trauma, pulmonary contusion and laceration, traumatic pneumatocele and a 10% laminar pneumothorax, with a guarded prognosis. A CT scan ruled out brain or spinal injury.
On March 25, 2025, the on-duty physician at Hospital H+ Los Cabos described the injuries to a state investigator as ones that "may put her life at risk" (translated from Spanish).
Her discharge order records that she was hospitalized from March 25 to March 28, 2025. She was discharged with instructions to avoid immersion in water and contact sports.
The authorities heard from the hospital
Police received no report from the scene. According to the March 27, 2025 report, municipal traffic police had no record of the crash at 12:54 p.m. That is the time at which municipal police handled a report about it through C2, a command and monitoring center.
Records show that word of the crash reached the authorities from Hospital H+ Los Cabos, not from Querencia's staff. The page on how the authorities found out has more detail.
Two acts by the hospital are documented, and they are distinct. One is the hospital's notice to prosecutors (aviso al Ministerio Público), timed 12:20 p.m. The other is a report from the hospital through C2, which municipal police handled at 12:54 p.m.
From there, officers arrived at the hospital at 1:15 p.m. and notified the early-attention unit at 2:31 p.m. At 2:59 p.m., that unit alerted the investigative police (Policía de Investigación).
The truck was not inspected where the crash happened. According to its inspection record, it was examined at a body shop at 12:26 p.m. on March 26, 2025.
How a criminal case works in Mexico, in plain English
A few features of the Mexican system help explain the steps below. The state Public Prosecutor's Office (Ministerio Público) investigates crimes and brings charges before a judge. In Baja California Sur, that office belongs to the state attorney general's office (Procuraduría General de Justicia del Estado de Baja California Sur).
Prosecutors gather what they find in an investigation file (carpeta de investigación). A pretrial judge (Juez de Control), who oversees the investigation stage, hears requests from prosecutors before any trial. Once a judge is involved, the matter becomes a criminal case (causa penal).
The initial hearing (audiencia inicial) is where prosecutors may formally bring charges; it is not a trial. In Mexican law, that step is called formulación de imputación. Until it takes place, the people and companies involved are under investigation. In the records of the case, the driver and the club's doctor are both under investigation.
From the accident to a criminal case
The investigation file was opened for four offenses: unintentional bodily injury, failure to render aid (omisión de auxilio), property damage and failure to file a medical report (omisión de informe médico). A summary by topic is in what is on record in the criminal case.
On July 15, 2026, prosecutors asked the pretrial judge to hold a hearing to formally charge three parties. They are the driver and the club's doctor, both under investigation, and Querencia Construcciones, named in that July 15, 2026 request for a charging hearing. The judge's order of July 16, 2026, scheduled that hearing for August 26, 2026. Details are on the page about the request for a charging hearing.
The August 26, 2026 hearing was postponed to September 30, 2026, after the judge asked prosecutors for the name of the legal representative of the company under investigation. The page on what happened before the pretrial judge covers the hearings.
