Querencia Golf Club and the March 25, 2025 Accident Case in San José del Cabo, Mexico: What the Record Shows

On March 25, 2025, on Boulevard Querencia in San José del Cabo, Baja California Sur, Mexico, a truck bearing Querencia markings rear-ended a golf cart, and a 5-year-old girl was thrown from it. According to a statement in the investigation file, she was then struck by Querencia's truck, which weighs more than 500 kilograms (over 1,100 pounds). Querencia Golf Club, S. de R.L. de C.V., appears in the case record. According to a decision dated February 11, 2026, and its authorization, a state prosecutor proposed not prosecuting it and three other parties for failure to render aid, failure to file a medical report and concealment. The same decision did seek prosecution of the driver, who is under investigation, for unintentional bodily injury and property damage. According to the transcription of the ruling, a pretrial judge revoked that decision on September 23, 2026, because it was not grounded in law or reasoned, and ordered the investigation to continue. In the same ruling, the judge considered that not prosecuting was warranted as to the companies.

What happened on March 25, 2025

At about 10:15 a.m., on Boulevard Querencia across from the practice range, the truck hit a golf cart from behind. The cart carried an adult and three children.

The girl was thrown from the cart. According to a statement in the investigation file, she was then struck by Querencia's truck, which weighs more than 500 kilograms (over 1,100 pounds). The file (carpeta de investigación) is kept by Mexico's state prosecutors, the Ministerio Público.

At about 10:40 a.m., according to records from police and from the prosecutors' early-attention unit, she arrived at Hospital H+ Los Cabos, accompanied, among others, by the club doctor, who is under investigation.

The authorities learned of the crash from the hospital, not from Querencia staff. No alert reached the police from the scene: according to the police report, municipal traffic police had no report of the crash when C2, a command and monitoring center, reported it at 12:54 p.m.

According to the medical records, her diagnoses included, among others, pediatric polytrauma, blunt chest trauma, a pulmonary contusion and laceration, and a pneumothorax, with a guarded prognosis. The on-duty physician at Hospital H+ Los Cabos told a state investigator on March 25, 2025, that the injuries "may put her life at risk" (translated from Spanish).

Her discharge order shows she was hospitalized from March 25 to March 28, 2025.

The truck was inspected on March 26, 2025, at a body shop, not at the scene. According to the police report, the development's head of security told the investigating officer that a tow truck took it there moments after the accident. Who ordered the tow is not on record.

According to a statement in the investigation file, the truck was moved "without justification and with unusual promptness," which "makes it impossible to carry out any further investigative act," whether by the prosecutor's office or by independent experts (translated from Spanish).

Where Querencia Golf Club appears in the record

State prosecutors opened the investigation file over four offenses: failure to render aid (omisión de auxilio), failure to file a medical report (omisión de informe médico), unintentional bodily injury (lesiones culposas) and property damage (daños).

A decision not to prosecute (no ejercicio de la acción penal) formally declines to take specific conduct to a judge. Atipicidad means the conduct does not fit an offense's legal definition.

According to the decision, dated February 11, 2026, and its authorization, it proposed not prosecuting, for atipicidad, in favor of Querencia Real Estate, Querencia Golf Club, the club doctor, José Luis Sánchez Musi, who is under investigation, and the driver, for failure to render aid, failure to file a medical report and concealment (encubrimiento). As to the driver, who is also under investigation, the decision did seek prosecution for unintentional bodily injury and property damage (lesiones y daños culposos).

On July 15, 2026, a state prosecutor requested a charging hearing (audiencia de imputación), where charges may be formally brought; it is not a trial. The request named the driver and the club doctor, both under investigation, and Querencia Construcciones, S. de R.L. de C.V. Querencia Golf Club is not among them.

The two officials who issued and authorized the decision not to prosecute have been named in a criminal complaint filed with the authorities. The complaint alleges unlawful exercise of public service, falsehood by public servants and denial of justice.

What the pretrial judge decided

In Mexico, a pretrial judge (Juez de Control) oversees the investigation stage of a criminal case.

According to the transcription of the ruling, on September 23, 2026, a pretrial judge in Los Cabos revoked the decision not to prosecute, dated February 11, 2026, and authorized on February 13, because it was not grounded in law or reasoned (fundada y motivada), and ordered the investigation to continue. In the same ruling, the judge considered that not prosecuting was warranted as to the companies (personas morales).

The ruling also provided that prosecutors could issue a new decision, grounded in law and reasoned.

What Querencia has said on the record

The written response quoted here comes from a different company, Querencia Real Estate, S. de R.L. de C.V., answering state prosecutors. Querencia Real Estate submitted that written response on February 4, 2026, almost 11 months after the accident, signed by its attorney, Francisco Javier Troncoso Valle.

Among other points, it wrote that the minor "was taken to a hospital to rule out any injury that could result from the traffic incident" (translated from Spanish).

The company also wrote that the truck "is in operation within the Querencia development" (translated from Spanish) and offered it for inspection. According to the police report, a tow truck had taken it to a body shop moments after the accident.

On the companies, the decision dated February 11, 2026, had stated that "any liability that may arise is civil or administrative in nature, not criminal" (translated from Spanish). According to the transcription of the ruling, the pretrial judge revoked it as not grounded in law or reasoned and ordered the investigation to continue. In the same ruling, the judge considered that not prosecuting was warranted as to the companies.

Hospital records are covered in the girl's injuries, according to the hospital.
